Here are a few examples of Debt Solutions available…

Individual Voluntary Arrangement (IVA)

With this solution, you’ll normally pay part or all of your debt within 60 months. Debts need to be at least £5,000. All charges and interest are frozen when the agreement is signed. At the end of the agreement any debt not repaid will be written off. Do be aware that creditors can object, you will need to release equity from any property you own and that the IVA Supervisor obtains rights to your assets.

There are restrictions on your spending once you have entered in to an IVA or protected Trust Deed. This is for the full term of the agreement.

Debt Management Plan (DMP)

In a DMP, you repay your debts in full at a monthly rate you can afford. You can arrange a plan for any debt and your assets are not included, but there is a chance your creditors could continue to add charges and interest. This type of agreement is not legally-binding.

Debt Relief Order (DRO)

This solution is perhaps best suited to those with few assets and little disposable income. Your debts must come to less than £20,000, your assets to no more than £300 and you can obtain one DRO every six years. Your debts will normally be cleared within 12 months.

Minimal Asset Process (MAP)

This option is ideal for those with low income and few assets. You’ll need to have debt between £1,500-£17,000 and you can’t have assets of more than £2,000 or be a homeowner. An application fee of £90 applies.

Protected Trust Deed (PTD)

Using legislation, designed to help Scottish residents clear debt, a Protected Trust Deed (PTD) acts as formal agreement between you and your creditors. The PTD stops all creditor demands for those creditors that are bound by the arrangement. This enables you to pay off your debts in affordable monthly payments over a fixed period (usually 48 months).

Debt Arrangement Scheme (DAS)

A DAS enables you to repay your debts in full without paying interest over a maximum of ten years. This option is for Scottish residents and sees charges and interest frozen at the date of application. It doesn’t include assets. Creditors may object to the agreement and you won’t see any debt written off, though you will have an extended period of time to repay it.

Bankruptcy

This is a formal arrangement for those wish debts they cannot pay within a reasonable period of time. You’ll need to pay £680 (England and Wales) or £647 (Northern Ireland) but could be discharged within as little as 12 months. All debts are written off at the end, though you could lose assets including your property. You may need to pay a monthly contribution for 36 months.

Bankruptcy does have risks. Applying for bankruptcy is relatively expensive – it incurs a £680 fee. Bankruptcy usually involves the sale of valuable assets you own, such as a car or house, to raise funds to pay back your creditors. You may also have to pay a monthly contribution towards your debts for up to three years, if you have enough surplus income. Your career might be affected whilst you go through bankruptcy – you will be unable to direct a company, for instance Bankruptcy can also include mortgages, but the property must be surrendered.

Sequestration

This is the Scottish version of bankruptcy and is designed for those who won’t be likely to settle their debts within a realistic time frame. Your debts must come to more than £3000, you won’t be eligible if you’ve been declared bankrupt in the last five years and you’ll need to pay an application fee of £200. You could be discharged within as little as 12 months and you’ll only have to make a contribution is you can afford to. However, your property could be sold if it has equity. Sequestration could affect your job prospects.

Not all debts can be included in an IVA, for example student loans, child support and maintenance, magistrate court fines and social fund loans are excluded from an IVA, but an allowance can be given to enable you to continue repaying these.
